1. What is this privacy policy about? wohnPartner ag, Dorfstrasse 15, 8512 Thundorf ("wohnPartner ag"), (hereinafter also "we", "us") collects and processes personal data that concerns you (e.g. website or office visits), applicants as part of an application process or other persons ("third parties").
In this privacy policy we describe what we do with your data when you use www.wohnpartnerag.ch, use our services, use our services, communicate with us or otherwise have dealings with us. We can also inform you separately about the processing of your data (e.g. in forms, contractual terms or additional data protection declarations).
We use the term "data" here synonymously with "personal data". "Personal data" refers to data that relates to specific or identifiable people and "processing" means any handling of personal data, e.g. obtaining, storing, using, changing, disclosing and deleting.

3. what data do we process?
We process various categories of your personal data. The most important categories are the following:
Master data: This is the basic data such as name, contact details, personal data, photos, care and customer history, declarations of consent and information about third parties (e.g. contact persons, information about the purchase).

Contract data: This is data that arises in the context of the provision of our services and when contracts are concluded, such as contractual services, data relating to the provision of services, data from before the conclusion of the contract, information on processing (e.g. invoicing) and financial data (e.g. information on the economic circumstances for financing).
Applicant data: This is data that arises in the context of an application for a job with us, such as professional career, training and further education, references and data from public sources (e.g. social media and the Internet). This also includes information about criminal convictions and professional / activity bans (in particular criminal records).
Communication data: This is data that arises in connection with communication between us and with third parties (e.g. by email, telephone, letter or other means of communication), such as the content of emails or letters, your contact details and peripheral data of the communication.
Registration data: This is data that we collect when you register (e.g. login areas, newsletter) or that you provide to us (e.g. email).
Technical data: This is data that is collected when you use our electronic services (e.g. website), such as IP address, information about the operating system of your device, the region and the time of use. Technical data in itself does not generally allow any conclusions to be drawn about your identity.
Behavioral and preference data: This is data about your behavior and preferences, such as reactions to electronic messages, navigation on the website, interactions with our social media profiles, participation in events, possibly supplemented with information from third parties (including from publicly accessible sources).
Other data: This includes in particular: data that arises in connection with official or legal proceedings (e.g. files), data that is collected for health protection reasons (e.g. protection concepts), photos, video or sound recordings that we make or receive from third parties and on which you are recognizable (e.g. at events, through security cameras, etc.), participation in events.

4. Where does the data come from?
From you: Much of the data we process is provided to us by you yourself (e.g. in connection with our services or communication with us). You are not obliged to disclose your data, with exceptions in individual cases (e.g. legal obligations). However, if you want to conclude contracts with us or use our services, for example, you must disclose certain data to us.

From third parties: We may also obtain data from publicly accessible sources (e.g. debt collection registers, media or the Internet including social media) or from authorities (e.g. municipalities, supervisory authorities), your employer or client who has a business relationship with us or otherwise deals with us and from other third parties (e.g. associations). This includes in particular the following categories: master data, contract data, customer data and other data, but also all other data categories according to section 3 as well as data from correspondence.

5. For what purposes do we process your data? Communication: In order to be able to communicate with you (e.g. to answer inquiries), we process your data. Marketing purposes and to maintain relationships: For marketing purposes and to maintain relationships, we process data, for example to send our customers, other contractual partners and other interested parties personalized advertising (e.g. in print, by email or via other electronic channels) about our services and other news. You can reject such contacts at any time or refuse or revoke your consent to be contacted for advertising purposes by notifying us (Section 2). Improving our services and our operations: In order to continuously improve our services (including the website), we analyze, for example, how you navigate through our website or which services are used by which groups of people and in what way. Security purposes and technical and physical access controls: For security purposes, we also keep visitor lists and use surveillance systems (e.g. security cameras). We will draw your attention to surveillance systems at the relevant locations using appropriate signs. Risk management and corporate governance: We may process personal data as part of risk management (e.g. to protect against criminal activities) and corporate governance, including our operational organization (e.g. resource planning) and corporate development (e.g. buying and selling parts of a business or companies). Other purposes: These other purposes include, for example, training and educational purposes, administrative purposes (e.g. managing master data or accounting), protecting our rights and evaluating and improving internal processes. The protection of other legitimate interests is also one of the other purposes, which cannot be listed exhaustively.
6. Who do we disclose your data to? In connection with our contracts, the website, our services, our legal obligations or otherwise to protect our legitimate interests and the other purposes listed in section 5, we also transmit your personal data to third parties, in particular to the following categories of recipients:
Service providers: We work with service providers in Germany and abroad who process data (i) on our behalf, (ii) jointly with us or (iii) on their own responsibility (e.g. IT providers, banks, insurance companies). This may also include health data.
All of these categories of recipients can in turn involve third parties, so that your data can also be accessed by them. We can restrict processing by certain third parties (e.g. IT providers), but not that of other third parties (e.g. authorities, banks, etc.).
7. Does your personal data also go abroad? We process and store personal data mainly in Switzerland and the European Economic Area (EEA), but in exceptional cases - for example via subcontractors of our service providers - potentially in every country in the world. If a recipient is located in a country without adequate legal data protection, we contractually oblige the recipient to comply with the applicable data protection (for this purpose we use the revised standard contractual clauses of the European Commission, which can be accessed here: eur-lex.europa.eu/eli/dec_impl/2021/914/oj?), unless they are already subject to a legally recognized set of rules to ensure data protection and we cannot rely on an exception. An exception may apply in particular in legal proceedings abroad, but also in cases of overriding public interests or if the execution of a contract requires such disclosure, if you have consented or if the data is data that you have made generally available and whose processing you have not objected to. 8. How long do we process your data? We process your data for as long as our processing purposes, the statutory retention periods and our legitimate interests in processing for documentation and evidence purposes require it, or if storage is technically necessary (e.g. in the case of backups or document management systems). If there are no legal, contractual obligations or technical reasons to the contrary, we will delete your data after 6 months of storage or processing as part of our usual procedures. 9. What rights do you have? You have certain rights in connection with our data processing. In accordance with applicable law, you can in particular request information about the processing of your personal data, have incorrect personal data corrected, request the deletion of personal data, object to data processing, request the release of certain personal data in a common electronic format or their transfer to other responsible parties or revoke consent, insofar as our processing is based on your consent. In order to rule out misuse, we must identify you (e.g. with a copy of your ID card, if necessary). Please note that conditions, exceptions or restrictions apply to these rights (e.g. to protect third parties or business secrets). We reserve the right to black out copies or to only provide extracts for data protection reasons or reasons of confidentiality. 10. How do we process data in connection with our website and other digital services? When using our website (including newsletters and other digital offers), data is generated that is stored in logs (in particular technical data). We may also use cookies and similar technologies (e.g. pixel tags or fingerprints) to recognize website visitors, record their behavior and identify preferences. A cookie is a small file that is transmitted between the server and your system and enables the recognition of a specific device or browser.

The technical data and cookies we collect do not usually contain any personal data. However, personal data that we or third parties commissioned by us store about you (e.g. if you have a user account with us or these providers) can be linked to the technical data or to the information stored in and obtained from cookies and thus possibly to you personally.

We also use social media plug-ins, which are small software modules that create a connection between your visit to our website and a third party. The social media plug-in tells the third party that you have visited our website and can transmit cookies to the third party that they have previously placed on your web browser. 11. How do we process data on our social network pages?
We can operate pages and other online presences on social networks and other platforms operated by third parties and process data about you in this context. We receive data from you (e.g. when you communicate with us or comment on our content) and from the platforms (e.g. statistics). The platform providers can analyze your usage and process this data together with other data they have about you. They also process this data for their own purposes (e.g. marketing and market research purposes or to manage their platforms) and act as their own controllers for this purpose.
